Under A.R.S. 39-121.03(D), a “commercial purpose” means the use of a public record for the purpose of sale or resale or for the purpose of producing a document containing all or part of the copy, printout or photograph for sale or the obtaining of names and addresses from public records for the purpose of solicitation or the sale of names and addresses to another for the purpose of solicitation or for any purpose in which the purchaser can reasonably anticipate the receipt of monetary gain from the direct or indirect use of the public record.

NOTE: Under A.R.S. 39-121.03(C), penalties may apply if public records are requested or used for a commercial purpose without proper disclosure. This includes failing to disclose a commercial purpose, using records for a different purpose than stated, or obtaining records from someone other than the official custodian for commercial use.

 

Public Records Request Fees

MCCCD is not required to perform custom programming, data extraction, or manipulation to fulfill public records requests, but may choose to do so at its discretion.

 

Commercial Purposes

Under ARS §39-121.03(A), MCCCD may charge fees for commercial requests based on: 

  1. A portion of the cost to the District for obtaining the original or copies of the records;
  2. A reasonable fee for time, materials, equipment, and personnel used in reproducing the records; and 
  3. The market value of the reproduction as determined by the District.

 

Non-Commercial Purposes

The only charge for records for non-commercial purposes is the cost of reproduction. The MCCCD does not charge for the cost of searching for the record nor the retrieval from off-site storage. The creation of records such as lists or special reports that do not readily exist in the form of a record are subject to an appropriate fee assessment.

Reproduction costs include:

  1. cost of paper and other media;
  2. cost of the machinery to do the reproduction; and
  3. cost of employee to do the reproduction.

Standard fees are Paper Copy - $0.25/per page, Digital Copy - $0.25/per page, Fax Transmittals - $1.00/per page, USB Flash Drive - $15.00 (If records are not readily maintained in an electronic format, then both a per page and USB charge shall apply). Postage fees may apply.
