Upon adoption of the Maricopa Governance framework, the Governing Board transferred certain policies to the Chancellor. Administrative Regulations are used by the Chancellor in managing the day-to-day operations of the Maricopa County Community College District (MCCCD).

Administrative Regulations are amended, adopted, or deleted as necessary and are subject to a formal approval process under the Chancellor’s authority.

Maricopa Governance is a framework adopted by the Governing Board that establishes accountability to its constituents through Governing Board Policies and Administrative Regulations. Governing Board Policies are adopted by the Board to provide the strategic direction and outcomes for the Maricopa County Community College District. They set forth the principles by which the Governing Board will guide itself regarding Board operations and to guide the Chancellor regarding management of the District.

The Governing Board considers proposed new or revised policy twice, first as an informational item, then as a recommendation for approval. Upon a majority vote, the policy is incorporated into the Board’s policies.

The following District employees are authorized by the Governing Board to accept service of process of any document such as Notice of Claim, Subpoenas, Lawsuits, garnishments, etc. upon the District:

1. Elza Macias, Executive Assistant to the Governing Board.
2. Janice Falkenberg, General Counsel, or designee.

The Senior Associate General Counsel for Business Services (SAGC) and the Senior Contracts Manager oversee all legal aspects of the contracts functions for the District.  This includes legal review of all Requests for Proposals issued by the district  (RFPs), reviewing and negotiating terms and conditions for all vendor/contractor/supplier agreements, and maintaining standard template agreements for the district and all colleges. The SAGC also conducts a privacy and security review of contractors who are given access to any sensitive data, information or systems.

The Office of General Counsel’s role in freedom of expression and First Amendment guidance is pivotal in upholding the principles of academic freedom while navigating the legal complexities surrounding free speech on campus. Our office is responsible for providing legal advice and guidance to university leadership, faculty, and staff on matters related to freedom of expression such as the right to peaceful assembly, the protection of controversial speakers, and the boundaries of academic freedom. General counsels also play a crucial role in handling potential legal challenges, balancing the need for open dialogue with the responsibility to maintain a safe and inclusive campus environment. Additionally, we assist in providing training to university stakeholders on navigating these issues in a manner consistent with legal requirements and the values of the institution.
